慎防中國計中計：陳同佳案，在收與不收之間

連日來，由於在台殺害港人女友後逃回香港的港民陳同佳欲來台投案一事，引起台灣社會輿論沸騰，議論紛紛，在本案的收與不收之間，涉及諸多因素。本人先前協助林克穎引渡案，乃就本案所涉之議題，簡單整理並分析如下，敬供各界參考。
林克穎案與陳同佳案不能相提並論
有觀點以英商酒駕撞死送報生為例，指出該案我國政府要求英方將被告引渡返台送審，在陳同佳案上卻避重就輕，顯然標準不一。但本案和英商林克穎案有相同與不同處，勿拿橘子比蘋果。
首先，林克穎在我國撞死送報生，經我國法院判決有罪後，變裝逃回英國，由於我國與英國間沒有引渡協議，所以在我國請求之後，我國先與英國簽署「關於林克穎引渡瞭解備忘錄」，而後在愛丁堡地方法院舉行引渡庭審理，林克穎律師向法官挑戰我國的國際地位，主張台灣無司法主權，並說即使台灣有司法主權，林克穎並未受到我國法院的公平審理，所以判決為無效。
做為英國法院的專家證人，我負責回答英國檢察官提出的各種問題，向法院說明為何我國有司法主權，為何刑事審判程序並未有違反人權或歧視外國人之偏頗，以及為何我國所為之有罪判決是有效判決。
之後，我們的努力獲得一審法院的認可，承認我國司法主權與判決之有效性，也使林克穎續押於英國。兩年後，林克穎上訴，主張我國監獄將單獨囚禁他，其在監獄內將無法獲得社會復歸等功能，故於蘇格蘭高等法院之上級審程序，判決不引渡。
是以，在林克穎案上，縱然英國蘇格蘭高等法院在本月6日宣判不予引渡林克穎回台服刑，然而我國與英方就本案簽署引渡備忘錄，蘇格蘭法院亦承認我國在此案具法律地位，皆為台英司法合作的先例。
然而陳同佳案件，雖然和林克穎案一樣，發生在台灣國境內，台灣確實也有管轄權，但是陳同佳沒有經過審判就逃回香港，所屬司法程序階段有所不同，此其一。
再者，在發生人犯逃離有引渡／移交之必要時，如無引渡條約，首要談判簽署協議，我國要求與隸屬中國但一國兩制之香港特區政府簽署協議（事實上，香港已經和多國都有異於中國和他國所簽之逃犯與司法互助協議），但香港政府始終置之不理，卻反而制訂引發軒然大波的「送中條例」，這也是和林克穎案不同之處。
林案中，我國第一步就是和英國簽署個案處理的備忘錄，做為後續程序的指引和規則。反觀香港特區政府，從陳同佳逃回香港後，港府始終拒絕與台灣做任何協議，背後當然有政治因素，這和林案單純為已受判決人逃跑離境，我方請求送回，各事實皆有不同，以林克穎案來全然類比陳同佳案並不適當。
陸委會與法務部可以怎麼做？
陳同佳案明顯具有政治目的，如果要單純投案，自己搭飛機來台，我方立刻逮捕即可，何以要由港府來發聲明說嫌疑犯要投案了，且港府要「協助其投案」？
香港特區政府想要「以投案包裝移送」，然後呈現「兩地無須協議即可移送，我家就是你家，我們同屬一國」的後續操作，不無有矮化我國的可能，導致陸委會高度警戒，不敢輕易接受陳同佳入境。
然而，即便陸委會的顧慮不是不能理解，維護國格用心良苦，但在兩岸政治操作與角力上，卻難以對一般人民說明。對無政治敏感度的大眾來說，只會質疑政府：「有人在我國殺人，現在要回來受審，你為何不收？」或是如近期被創造的口號「香港反送中，台灣反送台」般，不但社會觀感不佳，更令人質疑難道我國司法不足以信賴、非要香港司法審判才行？
事實上，我國司法當然足以信賴，士林地檢署也一直在積極偵查，本人認為更妥適、對政府傷害較低的作法，應該是先將投案者收下，不管他是「自願投案」或「被投案」，我國既然有司法主權，且行為地在台灣，我國法院當然具有審判權，入境後即刻逮捕，對案件給予偵查，決定是否起訴審判。而期間需要各種證據、文書，我國可持續要求港府與台灣簽訂協議，做司法互助，如果港府依然置之不理，則責任在特區政府而不在我方。
究其實，我國既可發佈聲明，譴責港府欲以投案包裝移送，進行政治操作，意圖讓我國穿小鞋，矮化我國格，且遲遲不願與台灣協議，使司法互助無法常態化的行為，同時亦可收陳同佳入境以彰顯我國司法主權。換言之，可以收，更可以罵，兩者可併行、完全沒有擇一的必要，而讓我國政府陷於被人民不諒解的風險中。
中國從來就不是一個可以輕忽的敵對勢力，我國在每一步的應對中，應格外謹慎小心。除慎防中計，更要慎防「計中計」。
